How Do You Know if You’re Hiring an Undocumented Worker?
Hiring an undocumented worker, even unintentionally, can trigger serious consequences. In April 2025, ICE issued over $8 million in fines to three Denver-area janitorial companies after audits found between 44 to 87 undocumented employees each, with violation rates ranging from 74% to 100% (Lawrence Lee).

How the E-Verify / I-9 Process Works
- Complete Form I-9 First
Before using E-Verify, you must have a properly completed Form I-9 for the employee.
- Create an E-Verify Case Within 3 Business Days
You must open a case in E-Verify within 3 business days of the employee’s first day of work.
- Post Required Notices
Display E-Verify Participation and Right to Work posters in English and Spanish (and other DHS-provided languages if needed).
- Address Mismatches Properly
If E-Verify shows a mismatch, you must:
- Give the employee written notice (Further Action Notice).
- Give them 8 federal business days to contact SSA or DHS.
- Avoid any adverse action (termination, pay cut, suspension) until a Final Nonconfirmation result is issued.
- Close the Case
Once resolved — or if there’s a Final Nonconfirmation — close the case in E-Verify.
